TERMS AND CONDITIONS

  1. These General Terms and Conditions apply to all sales of goods by CASTALIA not withstanding any  conflicting, contrary or additional terms and conditions in any purchase order or other  communication from customer. No alteration or variation shall be of any force or effect unless such change is reduced to writing and signed by both parties.
  2. Agents or distributors of the Company’s Goods have no right or authority, express or implied, to bind the Company.

C. The Company may vary these conditions by agreement in writing with the Customer. D. A Quotation given to the Customer is not an offer, and is valid for 30 daysfrom the date of Quotation. E. An order placed by the Customer under a Quotation is not binding on the Company until accepted in  writing by the Company.

When accepting a quote for a custom piece, we will assume that you understand and agree to our  Terms and Conditions. Once your deposit has been received you will remain bound by the content  within it. No adjustments or variations may be made to this document, unless expressly agreed  upon, ahead of time, by Built Furniture and you.

  1. Prices for Goods will be as per the Company’s Official Price List.
  2. Delivery charges, extra packaging surcharges etc., if any, are payable by the Customer. C. For product orders, customer shall pay The Company a 50% down payment (equivalent to half the price of the product) before the design process, order manufacturing or project management can commence. The down payment is non-refundable once the design is confirmed by the customer  and when our production starts. 
  3. The purchase price of the Products shall be paid to CASTALIA upon presentation of the relevant  invoice. Goods remain the property of the Company until paid in full. 
  4. Payments made by EFT (Electronic Funds Transfer) require a 48-hour period in order for the funds to  clear and to allocate them to the relevant order/s. Goods will only be released for collection or delivery once the receipt of funds has been confirmed.
  5. If the Customer fails to make any payment on due date, all amounts owing by the Customer, whether  or not the date for payment has arrived, will immediately become due and payable by the Customer.  In such a case, the Customer shall also immediately forfeit all discounts of whatsoever nature which  may have been granted to it by CASTALIA.
  1. The Customer acknowledges that a delivery date given in advance is an estimation of delivery date and  while CASTALIA will endeavour to ensure that delivery is completed as soon as is reasonably possible  after the estimated delivery date, it shall not be liable for delays resulting from any cause beyond its  control. 
  2. Risk in and to the Product/s pass to the Customer upon delivery. 
  3. Upon receipt of the Product/s the Customer will inspect the Product/s and must inform CASTALIA of any  errors by way of written notice within 7 (seven) days of receipt of the Product/s by the Customer. In the  event that the Customer fails to notify the company within the specified time period, such failure shall  constitute a waiver of any such claim. 
  4. Any Product/s delivered to the Customer in error will only be considered for return by CASTALIA if the  Product/s are undamaged.

Products sold may only be returned and refunded within 7 (seven) days of invoice date, upon  presentation of the invoice and on condition that the product/s are returned undamaged and in their  original condition. Notwithstanding the above, products that have been discounted or are on sale, may  not be exchanged or returned.

  1. The Company will be responsible for any manufacture defects for one (1) month after the product’s delivery, unless otherwise stated in the contract. The Company bears no responsibility for the wear and tear or inappropriate use of finished items after the one (1) month period.  
  2. All natural or manmade resource materials including marble, granite, veneer, solid wood, laminate, plywood, fabric, genuine leather, metals etc. may have watermarks, spots or tone irregularities. These irregularities are caused naturally and will not be considered as defects. Based on conditions  and furniture placements, the natural and manmade materials might experience following: hairline  cracks, unevenness, material odors, shrinkages, irregular polishes, slight natural scratches, stone  crystallizations, different stain tonalities, and so on. All above mentioned claims are not considered  to be defects. The Company reserves the rights to refuse any claims that are related to material  characteristics.
  3. Castalia will only be liable to honour a warranty if:
  • The defect existed at the time of delivery and manifested during the warranty period; The defect did not arise due to normal wear and tear or misuse/abuse by the Customer; The product concerned is used for the purpose intended and in a domestic/residential environment.

The Customer duly complied with the care instructions and maintenance and the Customer  provides the original invoice.

The Customer agrees to indemnify the Seller against all liabilities, losses, damages, costs, claims,  fines or expenses which the Seller may suffer as a result of the breach of the Contract and/or these  Conditions by the Customer including its directors, officers, employees, agents, contractors,  franchisees, successors or assigns.

All notices, requests, consents, claims, demands, waivers and other communications hereunder  (each, a “Notice”) required to be in writing under these Contracts shall be addressed to the parties  at the addresses or the contact number provided. All Notices shall be delivered by personal  delivery, courier, certified or registered mail, WhatsApp etc..

CASTALIA RESERVES THE RIGHT TO ADJUST/MODIFY THE ABOVE TERMS & CONDITIONS.
